If you request to cancel within 7 calendar days of your last monthly billing cycle, we will gladly issue you a refund for that current month. 3. REMEDIES
Traders Edge’s entire liability, and the purchaser’s exclusive remedy, shall be a refund of the price paid or replacement of our products, at our option. We limit replacement to thirty days. All remedies are limited to the United States.

If you take legal action relating to this User Agreement, you agree to file such action only in the state and federal courts in Salt Lake City, Utah, and you consent and submit to the exclusive personal jurisdiction of those courts for the purposes of litigating any such action.
If any part of these Terms of Use is unlawful, void or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining provisions. BY ACCEPTING THIS AGREEMENT, YOU WAIVE AND HOLD HARMLESS TRADERS EDGE FROM ANY CLAIMS RESULTING FROM ANY ACTION TAKEN BY TRADERS EDGE DURING OR AS A RESULT OF ITS INVESTIGATIONS AND/OR FROM ANY ACTIONS TAKEN AS A CONSEQUENCE OF INVESTIGATIONS BY EITHER TRADERS EDGE OR LAW ENFORCEMENT AUTHORITIES.
5. LIMITATION OF LIABILITY & INDEMNIFICATION
A. INDEMNIFICATION
You will indemnify and hold Traders Edge, its subsidiaries, affiliates, licensors, content providers, service providers, employees, agents, officers, directors, and contractors (hereinafter known as the “Indemnified Parties”) harmless from any breach of this User Agreement by you, including any use of Content other than as expressly authorized in this User Agreement. You agree that the Indemnified Parties will have no liability in connection with any such breach or unauthorized use, and you agree to indemnify any and all resulting loss, damages, judgments, awards, costs, expenses, and attorney’s fees of the Indemnified Parties in connection therewith. You will also indemnify and hold the Indemnified Parties harmless from and against any claims brought by third parties arising out of your use of the information accessed from this site.
B. LIMITATION ON LIABILITY
TRADERS EDGE, ITS SUBSIDIARIES, AFFILIATES, LICENSORS, SERVICE PROVIDERS, CONTENT PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, AND DIRECTORS WILL NOT BE LIABLE FOR ANY INCIDENTAL, DIRECT, INDIRECT, PUNITIVE, ACTUAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR OTHER DAMAGES, INCLUDING LOSS OF REVENUE OR INCOME, PAIN AND SUFFERING, EMOTIONAL DISTRESS, OR SIMILAR DAMAGES, EVEN IF COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
In no event will the collective liability of company and its subsidiaries, affiliates, licensors, service providers, content providers, employees, agents, officers, and directors, to any party (regardless of the form of action, whether in contract, tort, or otherwise) exceed the greater of one-hundred dollars ($100) or the amount you have paid to company for the applicable content, product or service out of which liability arose.
6. MISCELLANEOUS
A. INTEGRATION AND SEVERABILITY
If any provision of these Terms and Conditions is deemed unlawful, void or for any reason unenforceable, then that provision will be deemed severable from these Terms and Conditions and will not affect the validity and enforceability of the remaining provisions. These Terms and Conditions represent the entire agreement between Traders Edge and you relating to the subject matter herein, except that Traders Edge’s relationship with its customers is governed by the Traders Edge account agreements.
B. TERMINATION, SUSPENSION OR MODIFICATION
The rights granted to you herein terminate immediately upon any violation by you of this User Agreement. Traders Edge reserves the right to terminate, suspend or modify your access to the Website at any time, without notice, for any reason whatsoever. You agree that Traders Edge shall not be liable to you or any third party for any termination of your access to this Website.
